Contract / Release & Waiver of Liability
Gilbert and Robin Nall and Robin’s
Nest (collectively "RN") agree to permit the
undersigned know as Lessee & Lessee’s and the Lessee’s
guest to use the lake
and those parts of the premises as indicated to them in writing &
verbally as listed
under rules & signs posted on property.
Appropriate to use, during the time when RN has the undersigned so scheduled.
In exchange the Lessee’s agrees to the following :
1. Lessee and
Lessee’s guest and their heirs release and agree to hold harmless
RN, it’s
owners, landowners, employees, agents and heirs from any and all liabilityarising
from negligence or otherwise for damage as a result of Lessee’s
use or Lessee’s guest use of the lake and premises.
The release includes, but is not limited to, property damage , bodily
, personal or mental injury, including death or other injury.
2. Lessee and Lessee’s guest acknowledge it is the soul responsibility of the undersigned to evaluate carefully the risk inherent in use of the premises, including, without limitation, dangers posed by negligent or other conduct by RN, its owners, landlord, employees, agents, or heirs and Lessee and Lessee’s guest voluntarily assume the full responsibility for, and full risk of, property damage, bodily, mental, or personal injury, including death, or other injury relating to the use of these premises.
3. Lessee and Lessee’s guest understand that any damages caused by our stay will be charged to the undersigned who shall be jointly & severally liable for such damage.
4. We agree that if any portion of this document / contract is held invalid, the remaining provisions shall be binding and continue in full force and effect.
5. ALL FISH MUST BE
KEPT IN NET IN THE WATER AT ALL TIMES,
( Taking Of Photos Is Permitted, But Same Above Rules Apply )
6. NO Firearms Allowed On Premises
7. No Throwing Of Gravel / Rocks In The Lake
The Undersigned
Understands that any violation of above rules / contract / document
may result in
Immediate Termination of lessee’s occupancy of the premises
with no refund of fees.
